Registering as Autónomo in Spain: Two Filings, and a Cuota That Is Only Provisional

The alta itself is smaller than its reputation: two filings, and an afternoon. What catches people out is that the monthly figure you pay in your first year is a forecast, and Social Security trues it up against your tax return long after the year has closed.

You have decided to work for yourself in Spain. The registration itself is smaller than its reputation: two filings, neither of which typically carries a fee, both possible in a single afternoon once your paperwork is in order. What catches people out is not the alta. It is what happens to the number on your Social Security bill over the following two years, because the amount you pay in month one is provisional and almost nobody is told so at the counter.

Two filings, not one

Becoming autónomo means telling two different institutions two different things. The Agencia Tributaria needs to know that you are starting an economic activity, what that activity is, and how you expect to be taxed on it. The Tesorería General de la Seguridad Social needs to enrol you in the Régimen Especial de Trabajadores Autónomos, usually shortened to RETA, which is the self-employed branch of the social security system.
  • Declaración censal, modelo 036. Registers you in Hacienda's census of business owners, professionals and withholders, and records the activity code, the epígrafe IAE, that describes what you actually do.
  • Alta en RETA with the Tesorería General de la Seguridad Social. Enrols you in the self-employed scheme and starts the monthly contribution, the cuota.
Guides disagree about which of the two comes first, and in most ordinary cases the argument is academic, because both can be filed on the same day. Timing relative to the work is what matters. Under current rules the RETA alta can typically be requested up to 60 days before the activity begins, and the census declaration is normally expected before your first invoice leaves your desk. Until Hacienda has the 036, you generally cannot issue a valid invoice or deduct a business expense, so being early costs nothing and being late tends to cost real money.

The modelo 037, the simplified census declaration, no longer exists. Orden HAC/1526/2024 removed it with effect from 3 February 2025, and every census filing now runs through the modelo 036. A good deal of English language guidance still tells readers to file a 037, so if a checklist mentions it, the checklist is out of date.

RETA is the half people underestimate, because it looks like nothing but a bill. Contributing is what connects you to public healthcare in your own right rather than as somebody's dependant, builds the record a future Spanish pension is calculated from, and opens access to sick leave and the cessation of activity benefit. For several residence permits it is also the running evidence that you are genuinely doing the work you said you would do.

Not every autónomo is a freelancer

The word covers two quite different people. Most newcomers register as individual autónomos, invoicing clients in their own name. If instead you run the business through an SL and hold a controlling stake or a directorship, you are usually an autónomo societario, and the arithmetic below changes: a smaller generic expense deduction and a different minimum contribution base. Same word, different sums. It is much easier to settle which one you are before the alta than to unpick it afterwards.

The 80 euro rate, and who actually keeps it

New autónomos can usually apply for the tarifa plana, a reduced flat contribution of 80 euros a month for the first 12 months, regardless of what the business earns in that period. It is requested as part of the alta rather than claimed afterwards, and forgetting to ask for it at that moment is the most common way people lose it.
  • You should not have been registered as autónomo in the two years immediately before, or three years if you have already used this reduction once.
  • It is not available to an autónomo colaborador, the family member registered under someone else's activity.
  • You need to be clear of outstanding debts with Social Security and with Hacienda.
  • It is requested at the point of registration, through the Importass portal or as part of the alta itself.
Months 13 to 24 are conditional rather than automatic. The reduced rate can typically be extended for a second year only where projected annual net income stays below the minimum wage, the salario mínimo interprofesional, and the extension has to be declared to Social Security rather than arriving by itself. A good first year is, in effect, paid for with the second year of flat rate.

After the flat rate, your cuota is a forecast

Outside the flat rate, Spain contributes by real income. There are 15 brackets, three in a reduced table and twelve in a general one, and you place yourself in the one matching your forecast monthly net income. For 2026 the tables carried over from 2025, with the overall contribution rate edging up to 31.5% as the intergenerational equity mechanism, the MEI, moved from 0.80% to 0.90%. In practice the range runs from roughly 205.88 euros a month at the bottom to roughly 1,606.88 euros at the top.
The figure that decides your bracket is not turnover. It is rendimiento neto: what you invoiced, less the expenses you are entitled to deduct, less a further generic deduction of 7% for most individual autónomos and 3% for autónomos societarios. Newcomers routinely place themselves several brackets too high by reading the word income as everything that landed in the bank account.

Your bracket is not fixed for the year. It can be changed up to six times, with each change taking effect on 1 March, 1 May, 1 July, 1 September, 1 November or 1 January. A quiet quarter and a busy one can both be reflected in what you pay, which matters more than it sounds if your work is seasonal.

Income that moves month to month is exactly why the contribution system treats your bracket as a forecast rather than a fact.

The true-up, and why it arrives so late

Everything paid under this system is provisional. After the year closes, Social Security receives your actual income data from the Agencia Tributaria, compares it against the brackets you contributed in, and settles the difference. Contribute below your real income and you are billed for the gap. Contribute above it and the excess is normally refunded without you applying for anything, although you may also choose to keep the higher contributions, and the larger future pension they buy, instead of taking the money back.

The lag is longer than almost anyone expects. The first full regularisation, covering the 2023 contribution year, ran from December 2024 to April 2025, with refunds processed between 3 March and 30 April 2025. Of the roughly 3.7 million people registered as self-employed in 2023, the ministry reported that 50.7% needed an adjustment: 26.8% had contributed above their real income and 23.8% below it. Around half of the entire scheme, in other words. Notification arrived through Social Security's electronic notifications and the DEHú portal, not by post, which is its own small trap for anyone who has never opened either.
⚠️A first year that goes better than forecast produces a bill you will not see for well over a year. If your income is running ahead of the bracket you chose, the safer habits are to move up at the next change date, or to set the difference aside deliberately. What you eventually pay is generally treated as a deductible Social Security expense in the year it is actually paid, which softens the blow, but only after it lands.

What else lands on the calendar

Registration also switches on a filing rhythm. Most autónomos settle into quarterly returns and then an annual one, and the quarters come round faster than the first year's optimism suggests.

  • Modelo 303, quarterly VAT, with modelo 390 as the annual summary.
  • Modelo 130, quarterly payments on account of income tax, where your clients are not already withholding at source.
  • Modelo 100, the annual income tax return, filed in the spring following the year it covers.
  • Withholding declarations such as modelos 111 and 115, if you pay staff or rent a business premises.
One further obligation is coming rather than already here. Veri*Factu, the certified invoicing standard created by Royal Decree 1007/2023, will require invoicing software to produce unalterable, individually identified records capable of being reported to the tax agency as they are issued. It was originally set to reach self-employed workers on 1 July 2026. A royal decree-law approved on 2 December 2025 pushed the timetable back, and the dates now stand at 1 January 2027 for companies and 1 July 2027 for autónomos. If you are picking invoicing software this month, picking one that is already compliant costs nothing extra and spares you a migration later.

Getting the alta right the first time

  1. Have your NIE and either a digital certificate or Cl@ve working before you start. In practice both filings are electronic.
  2. Choose the epígrafe IAE that genuinely describes the work. It drives your VAT treatment and your withholding obligations, and correcting it later means another 036.
  3. Ask for the tarifa plana inside the alta, not after it.
  4. Set your first bracket from an honest forecast of net income rather than turnover, and put the next change date in the calendar the same day.
  5. Set up the direct debit account. The cuota is charged monthly and arrears attract surcharges rather than reminders.

None of this is difficult in isolation. It is the sequencing that catches people: a census form filed after the first invoice, a flat rate not requested at the one moment it can be requested, a bracket chosen from the wrong number and then left untouched for twelve months. An hour with somebody who does this every week is usually enough to get the alta clean, and the alta is the part that is genuinely awkward to unwind afterwards.
